Maryland
legalized the use of medicinal marijuana in 2003. However,
marijuana possession is still a crime in Maryland. The
maximum penalty for possession of marijuana is a fine
of $1,000 or one year in jail or both.
Unfortunately,
the statute does not stop a court from entering a
finding of guilt against such a defendant,
even if he or she has a legitimate medical necessity
for possessing marijuana.
